National Popular assembly
The National Popular Assembly (APN) is the supreme organ of the state power. Their powers include/understand the one of legislation, those of appointment and destitution, the one of decision making and the one of supervision.
1. To be able legislative of the State: The APN has the power to amend the Constitution and to elaborate and to review the laws regarding the penal subjects, to the civil subjects, the structure of the State and other fundamental laws.
2. To be able to choose, to decide and to dismiss to the members or leaders of the supreme organs of the State: The APN has the power to choose to the members of their Permanent Committee; to choose the President and Vice-presidents of the People's Republic of China; to decide the candidate to Premier of the Council of State and the candidates to Vicepremieres, Advisers of State, ministers, directors of commission, General Auditor, Secretary General; to choose the President of the Central Military Commission; to decide the candidates to other positions of the Central Military Commission; and to choose to the president of the Supreme Popular Court and the president of the Supreme Popular Office of the public prosecutor. The APN has the power to dismiss to the members of the supreme organs of the State chosen or decided by her.
3. To be able to decide on the important subjects of the State: The APN has the power to examine and to ratify the report on the execution of the plan of economic and social development; to examine and to ratify the report on the presented/displayed state budget and the execution of the previous budget; to ratify the independent institution of provinces, regions and municipalities directly subordinated to the Central Government; to decide the establishment of special administrative regions and its systems; to decide on the declaration of the war and the company/signature of La Paz; and to attribute the powers that consider necessary to exert like supreme organ of the power of the State.
4. To be able to supervise the other supreme organs of the State: The APN supervises the implementation of the Constitution. According to the briefed thing in this one, the Council of State, the Supreme Popular Court and the Supreme Popular Office of the public prosecutor are chosen by the APN, respond before her and accept their supervision. The exercise of the power of supervision on the part of the APN means that, in representation of the town, it supervises to the government and to the other organs of the State. One is an important condition that allows to guarantee on-speed operation of the state apparatus and its management of the subjects according to the law.

The effective Constitution and the pertinent laws estatuyen that the APN celebrates a session to the year in the first trimester and that this one is summoned by their Permanent Committee. The APN renews every five years.
The Permanent Committee of the APN is the permanent organ of the supreme organ of the power of the State and the legislative organ of the State. During receso of the APN, it has the supreme power of the State and the legislative power of the State. The Permanent Committee of IX the APN is made up of 134 members, that, in order to be able to supervise with greater facility the work of the administrative agencies, judicial and fiscal of the State, cannot hold positions in these organs.
The Permanent Committee of the APN has the power to interpret the Constitution and to supervise its fulfillment, to elaborate and to modify all the laws, except which they must be elaborated by the APN, and, during receso of this one, to add and to review partially, and to interpret the laws elaborated by the APN.
The special commissions of the APN are their organisms of permanent work. During the celebration of the APN, the work of these commissions consists mainly of studying, examining or to prepare the pertinent motions. During receso of the APN, they work under the direction of the Permanent Committee of the same. IX the APN established nine dedicated special commissions, respectively, to the ethnic subjects, the laws, the subjects of the interior and justice, the economy and the finances, the education, science, the culture and the public health, the outer subjects, the Chinese subjects of the overseas ones, the protection of the environment and the natural resources, and agriculture and the field.
