It is the supreme judicial organ of China, that responds before the APN and their Permanent Committee. The Supreme Popular Court (TPS) exerts by law of independent way the supreme judicial authority, without allowing the intervention of no executive organism, social or individual organization. The TPS has established the Committee of Judgments, that is the organism of judgment of supreme instance. It has also instituted several courts, among them the First Court of Penal Causes, the Judged Second of penal Causes, the Court of Civil lawsuits, the Court of Economic Causes, the Court of Administrative Causes, the Court of Demands and Appeals and the Court of Causes of Communications and Transports. According to the prescribed thing in the Constitution and the laws, the TPS has three main functions: 1) To instruct the cases of national importance, the cases of appeal in which the parts are not in agreement with the verdicts or failures of the courts superiors, and the cases that the TPS considers that they must be seen by him. 2) To supervise the judicial action of the local popular courts and the special courts, to revoke its verdicts if it considers them erroneous, to decide interrogations and to order the re-opening of processes. 3) To make interpretations legal exceeds how to apply the laws of concrete form in the development of the judgments, interpretations that must be adopted by all the country. The President of the Supreme Popular Court is chosen by the APN. The duration of its mandate is of five years and it cannot carry out it for more than two consecutive periods. The Vice-presidents of the TPS, the members of the Committee of Judgments and the presidents, vice-presidents and judges of the courts are appointed and dismissed by the Permanent Committee of the APN. The present President of the TPS is Xiao Yang.
